Vaginal Mesh Injuries

Boston Vaginal Mesh Injury Attorney

Another striking example of defective medical products within the medical device industry, has been the use of transvaginal mesh. This product was hailed as a breakthrough medical development in the 1990's, as a way to fix pelvic organ prolapse (POP) in women.

Pelvic Organ Prolapse most typically happens to older women, several years after childbirth. Essentially, due to a weakening in the pelvic walls, the uterus - as well as other pelvic organs - can gradually drop down through the vagina. Frequently it occurs when a woman experiences menopause, or undergoes a hysterectomy. The condition can result in mild prolapse, where the uterine tissue, or other pelvic organs, descends into the vagina but does not project outside the vagina, to severe - in which the uterus (or other pelvic organs) essentially hangs out of the vagina. To rectify this problem, synthetic mesh was developed to act as a support, almost a "hammock" for the lower pelvic wall and boost the pelvic organs that collapsed downward through the vagina. Sounds like a good solution, at least in theory, right?

It wasn't. The use of transvaginal mesh has been subsequently documented to cause severe medical complications. As Boston, Massachusetts vaginal mesh injury law firm, we have seen many types of injuries that have resulted from the surgical use of this defective medical product. These injuries include:

  • Organ perforation - when the rough edges of the mesh cut through female organs near the vagina
  • Mesh contraction, creating vaginal distortion and pain
  • Infection
  • Abscesses
  • Urinary incontinence

Injury cases due to defective transvaginal mesh surgery are extremely complex, so whatever action you take, do not consult with a law firm that does not have expertise and extensive experience in litigating these types of cases. It takes far more than an "average lawyer" to successfully litigate such medically complex cases.

There are four types of Pelvic Organ Prolapse (POP):

  • Cystocele (bladder falls into vagina)
  • Enterocele (small intestine falls into vagina)
  • Rectocele (rectum falls into vagina)
  • Urethrocele (urethra falls into vagina)
  • Uterine prolapse (uterus falls into vagina)
  • Vaginal vault prolapse (roof of vagina falls into vagina - most commonly occurs after hysterectomy

Grading:

Severity of Pelvic Organ Prolapse (POP) is graded on a scale of 0 to 4 - 0 being the least severe, and 4 being the most severe. You can click here to learn more of these details. Unbelievably, the mesh - which has been successfully used for hernia repairs - was never tested for use in the vagina. The FDA's approval method, dubbed the 510(k), did not require testing of the mesh prior to its marketing to the public.

Doctors have performed more than 75,000 transvaginal mesh prolapse surgeries, to date. Shockingly, more than 10 percent of them failed. Because of that failure, thousands of women needed more surgery, to rectify and reverse the problem.

This type of information is shocking to the average person, but as Boston, Massachusetts vaginal mesh injury lawyers, we've seen this type of regulatory oversight too many times in the past. It's sad, but true. And the result is that innocent people are injured - or die - due to defective medical devices and the negligence of product manufacturers. In legal terms, such defective products fall under the law of product liability in Massachusetts.

★★★★★
"When I fell in that supermarket and knew I had broken my leg, one of the first things that went through my mind was, "How am I ever going to take on a company this size and receive any decent compensation for what's happened to me?" Because of you, I received a sizable settlement payment for my injury. I hope more people learn about the kind of legal talent you offer." Jeanine W.
★★★★★
"The act of placing my father in a nursing home was probably the most painful decision I've ever had to face. You took our case on, and you and your associates fought the owners of this business, tooth and nail. You never gave up. As a result, my father's estate was paid considerable money for his pain and suffering." Joan W.
★★★★★
"My whole life changed on a dark day in December 1989, when I was hit and pinned against a wall by a commercial delivery truck. I was almost DOA at the hospital Emergency Room. Because of my injuries, I cannot work full-time ever again. Because of you and your colleagues' work, I received a large settlement." Jim Y.
★★★★★
"My mother had suffered a heart attack in the fall, and the hospital doctors completely missed this in her vital signs and EKG. My mother died the next day, and she didn't have to. But because of your diligence and talent, her estate received a very large settlement payment, along with revised ER protocols to prevent such errors in the future. For my mother and future patients, we thank you for what you did for her." Dorothy W.
★★★★★
"When our son was hit by a car in a crosswalk, our one and only concern was his recovery and well-being. We had no idea what we were facing: A maze of obstacles put up in our path by the insurance company for the driver who hit our son - denying responsibility for the accident. If we hadn't had you by our side, we feel we would have been eaten alive by this insurance company's lawyers. You guided us from day one, and you never rested." Bob and Mary J.
★★★★★
"You know what impressed me most about you (aside from your legal talent)? I know that my injuries from my car accident weren't the worst that you had in front of you - my case was far from the biggest case in your office - but you represented me like my case was worth a million dollars. I can't thank you enough." Margaret G.
★★★★★
"There are two things that I will never forget about my car accident: The sound of screeching tires just before my car was hit by the other driver, and, much later, the sound of you telling me that the entire ordeal was over with, and that I was going to receive just compensation for my injuries. The rest, I want to forget - but I'll never forget you and what you did for me." Karen D.
